Giftcards may only be purchased through authorized Scribd channels and only in the increments offered by Scribd. To purchase a Giftcard, all information required by the purchase form must be provided, and the purchaser must provide valid payment information.
Giftcards may be redeemed toward the purchase of eligible products only on www.scribd.com. Redemption of Giftcards is subject to change in Scribd’s sole discretion. In order to redeem a Giftcard, the redeemer must have an existing Scribd account or create a new Scribd account, and thereby have agreed to be bound by all applicable terms, conditions, and policies. Failure to do so will void the Giftcard and cause it to be forfeited. Each Giftcard may only be redeemed one time, with the balance of the redeemed Giftcard added to the redeemer’s Scribd account. Purchases made by the redeemer after redemption are deducted from the redeemer’s Scribd account balance. If a purchase made by the redeemer exceeds the balance of a redeemed Giftcard, then the remaining amount must be paid with another payment method. No fees apply to the redemption of Giftcards.
Giftcards cannot be used to purchase other Giftcards. Giftcards cannot be combined with any other offer, reloaded, resold, transferred for value, or redeemed for cash, except to the extent required by law. Unused Giftcard balances in a Scribd account may not be transferred to another Scribd account. Unless you obtain Scribd’s prior written approval, Giftcards may not be used in connection with any marketing, advertising, or other promotional activities of any kind, including, but not limited to, via websites, Internet advertisements, email, telemarketing, direct mail, newspaper and magazine advertisements, sweepstakes, contests, or radio and television broadcasts.
- Risk of Loss.
The risk of loss and title for Giftcards pass to the purchaser upon Scribd’s electronic transmission of the Giftcard to the purchaser or the purchaser’s designated recipient. Scribd is not responsible for assuring that Giftcards are delivered to the purchaser or the purchaser’s designated recipient, including, but not limited to, because the designated email address is invalid, or the Giftcard cannot be delivered due to technical issues, as a result of any form of active or passive filtering of any kind, insufficient space in an email account, or any changed or cancelled email address. Scribd is not responsible if any Giftcard is lost, stolen, destroyed, or used without your permission.
Scribd has the right to close customer accounts and bill alternative forms of payment if a fraudulently obtained Giftcard is redeemed and/or used to make purchases as set forth above.
- Limitation of Liability.
SCRIBD MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFTCARDS, INCLUDING, BUT NOT LIMITED TO, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT A GIFTCARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND SCRIBD’S SOLE LIABILITY, WILL BE THE REPLACEMENT OF SUCH GIFTCARD. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.
Scribd and you agree that any action at law or in equity arising out of or relating to these terms will be filed only in the state or federal courts in and for Santa Clara County, California, and Scribd and you hereby consent and submit to the personal and exclusive jurisdiction of such courts for the purposes of litigating any such action.
Giftcards do not expire. In accordance with these terms and conditions, however, Scribd has the right to change redemption of Giftcards in Scribd’s sole discretion.
